Client Case Study: Former Colorado School Official Acquitted Of Sex Assault

Today’s client case study highlights a case of child sexual assault. Even though he was charged with four counts of sexual assault on a child, a Denver jury acquitted a former Colorado school official. Former Deputy Albuquerque Public Schools Deputy Superintendent Timothy Jason Martinez was declared not guilty of multiple child sex assault charges.

Martinez was hired by New Mexico’s largest school district despite being charged with sexually abusing two young boys in 2015 by Albuquerque’s then-superintendent Luis Valentino as his deputy.

Defense by Denver Legal Team

Timothy Jason Martinez worked for Denver Public Schools for 10 years, ending in 2012. In 2013, he was arrested in Denver for allegedly abusing two young boys and released on bond that included staying in Colorado.

He said he never touched the two boys inappropriately. The boys’ families knew him for a long time, as he had adopted one boy’s father when he was abandoned as a kid. Following the Albuquerque job controversy, a Denver judge increased his bail and ordered him to wear an ankle monitor.

Timothy testified that one of the boys came to stay with him in Denver in May 2013. He was worried about the boy’s filthy living conditions back home. When we got home from the visit, the boy told his mother Timothy had abused him. A second boy also claimed Timothy Martinez had abused him after the first boy made the allegation.

The defense attorney, Leonard Martinez, of Denver Legal Team, argued that the case was based on lies and inconsistencies. Attorney Leonard Martinez told the jurors that the 6-year-old boy’s mother coaxed him to lie about the abuse so she wouldn’t get in trouble with social services. Some of the boys’ relatives were also in on the scheme, Leonard Martinez said. The defendant and his lawyer are not related.

A Colorado judge declared a mistrial when the jury could not reach a unanimous verdict after discussing for about 2 1⁄2 days during the initial trial. Notably, Leonard Martinez expressed his disappointment over the jury’s inability to reach a verdict of not guilty for his client.
